  • Vexatious refusal to pay: When your insurance company fails to pay your claim under an auto insurance, health insurance, or homeowners’ insurance policy, it may have committed a tort and entitled you to a “first-party” cause of action. There are also instances of “bad faith,” when the insurance company of the at-fault party, such the other driver in a car accident, fails to settle with you within the driver’s policy limits.
